Gift Card & Platform Credit Terms

These Gift Card & Platform Credit Terms (“Credit Terms”) govern the purchase, redemption, use, and management of Demfati Gift Cards and Platform Credits (“Credits”). By purchasing, redeeming, or using any Credits on the Demfati platform, you agree to be bound by these Credit Terms, together with our Terms of Service and Privacy Policy.

1. Overview of Gift Cards and Platform Credits

Demfati Gift Cards are prepaid cards issued by Demfati that may be redeemed by presenting a valid card code at the time of checkout. Platform Credits are the electronic balance reflected in your Demfati account after a Gift Card code has been successfully redeemed. Credits are recorded on a dedicated, ledger-backed reward account in your name and can be applied only toward eligible paid Demfati actions, including event tickets, voting, forms, slots, merchandise, and related platform services. Credits are issued and managed exclusively by Demfati and are not issued, sold, or serviced by any other party.

2. Purchasing Gift Cards

Demfati Gift Cards are made available from time to time in various denominations within the limits set by Demfati in its sole discretion. The purchase price of a Gift Card must be received in full and in the currency in which the card is issued before the card is considered valid and redeemable. Gift Cards may only be purchased by individuals who are at least eighteen (18) years of age and are not subject to any legal restriction that would prevent them from making the purchase. Gift Card purchases are final at the moment of payment; however, certain consumer protection laws may give you additional rights that cannot be waived, and nothing in these Credit Terms limits such statutory rights.

3. Redemption and Issuance of Platform Credits

To redeem a Gift Card, you must enter the card code exactly as it appears on the card, without spaces, hyphens, or other formatting unless the code has been normalized by Demfati. Once a valid code is presented and verified by Demfati, the face value of the card will be credited to the reward account associated with the Demfati account of the redeeming user (“Platform Credits”). Each Gift Card code may be redeemed only once. If the value of a single card exceeds the applicable single-redemption limit, Demfati will either credit the full amount to your reward account or reject the redemption in its entirety, at its sole discretion, and will communicate any such decision to you at the time of redemption. Credits are not physical or digital bearer instruments; they are an accounting entry maintained by Demfati and held for your benefit until used in accordance with these Credit Terms.

4. Using Platform Credits

Platform Credits may be used, at the time of payment, toward the total amount due for any eligible paid action on the Demfati platform. When you elect to pay with Credits at checkout, the credited amount is applied against the amount you owe, and you are responsible for paying the remainder through an accepted payment method, if any. Credits may not be redeemed for cash, may not be converted into balances on any third-party payment service, may not be used to fund payouts or transfers to third parties, and are not transferable except where expressly permitted by law. Credits can only be spent through your own Demfati account, on your own paid actions, and solely for their intended purpose of purchasing goods and services offered through the Demfati platform.

5. Fees and Expiry

Demfati does not charge maintenance, dormancy, or inactivity fees on Gift Cards or Platform Credits. Gift Cards are valid until the expiry date shown on the card at the time of issuance, if any. Unless otherwise stated at the time of purchase or redemption, unredeemed Gift Cards and unused Platform Credits do not expire. Where a card or a portion of a credit balance carries an expiry date, any redemption or use after that date will be declined, and the associated value will no longer be available. It is your responsibility to use your Credits before any applicable expiry date.

6. Refunds, Returns, and Resolution

Purchases of Gift Cards and the issuance of Platform Credits are generally final and non-refundable. If a paid action that was funded in whole or in part with Platform Credits is cancelled, refunded, or fails to be delivered, and a refund is approved under our applicable Refund Policy, the refunded amount will be returned to the payment method originally used if the charge was made through a debit or credit provider; where the refund relates to Credits, the value will be credited back to your Platform Credits balance. Demfati reserves the right to withhold or reverse Credits in cases of suspected fraud, misuse, error, or violation of these Credit Terms, provided that we will make reasonable attempts to notify you before doing so.

7. Risk of Loss; Lost, Stolen, or Illegible Cards

Gift Cards and their associated codes are the equivalent of cash while in your possession. Lost, stolen, damaged, defaced, or otherwise illegible Gift Cards or codes will not be replaced, re-issued, or re-credited, except where required by applicable law. You are solely responsible for safeguarding the code, the physical card, and access to the Demfati account in which Platform Credits are held. Demfati is not responsible for unauthorized use of a Gift Card code or of your account, including any use resulting from the compromise of your login credentials. 8. Resale and Prohibited Uses

Gift Cards and Platform Credits may not be resold (with or without markup) except to the extent expressly permitted by applicable law, and may not be reproduced, copied, altered, reverse-engineered, or used in connection with any fraudulent or misleading activity. Demfati may refuse to honour any Gift Card or credit balance that appears to have been obtained or used fraudulently, through a system error, or in violation of these Credit Terms. Without limiting the foregoing, Credits may not be used to purchase other Gift Cards or to generate, manufacture, or launder value through any scheme or loop.

9. Balance Inquiry and Statements

You may check the balance of your Platform Credits at any time in your Demfati account, including through the wallet area of the platform. Balance figures are advisory and reflect internally maintained records, which Demfati takes reasonable steps to keep accurate. In the event of any dispute between a recorded balance and Demfati’s authoritative ledger, the authoritative ledger maintained by Demfati’s bookkeeping systems will control, subject to your statutory rights.

10. Compliance with Law and Taxes

Credits represent a stored-value facility that you acknowledge and agree may affect, or be treated as affecting, your legal and tax position. You are solely responsible for any taxes, reporting obligations, or other legal consequences arising from your purchase, receipt, use, or redemption of Gift Cards or Platform Credits, including any unclaimed-property or escheat obligations. Demfati does not provide tax advice, and nothing in these Credit Terms constitutes tax, legal, or financial advice. Demfati may be required to report or remit amounts relating to Credits to regulatory or taxing authorities where required by applicable law.

11. Place of Reliance; Governing Law

These Credit Terms are entered into with Demfati Tech Hub, doing business as Demfati, a company registered in Nigeria with its registered office at 181 Etta Agbor Road, Calabar, Cross River State. By purchasing, redeeming, or using Credits, you acknowledge that you are relying on these Credit Terms as executed with Demfati, and to the fullest extent permitted by law, these Credit Terms are governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Credit Terms will be dealt with in accordance with the dispute resolution provisions of the Demfati Terms of Service.

12. Unclaimed Balances

In certain jurisdictions, unused Gift Card balances and unused Platform Credits may be subject to unclaimed-property or escheat laws, which may require Demfati to report and deliver such balances to a government authority after a defined period of inactivity. You acknowledge that Demfati may cooperate with such authorities as required by applicable law, and to the extent permitted, Demfati will use reasonable efforts to contact you before transferring any balance.

13. Amendments

Demfati may amend these Credit Terms from time to time by posting updated terms on this page and updating the Effective Date above. Any such changes will apply to Gift Cards purchased and Credits issued on or after the updated Effective Date and, to the extent permitted by applicable law, to existing balances upon your continued use of your Credits following the change. It is your responsibility to review these Credit Terms periodically.
